By signing up for an individual session, group meeting / “satsang” or retreat I understand the following: That a retreat, individual session or group meeting/”satsang” with Jon Bernie can be a powerful and at times stressful activity. I understand the retreat, individual session or group meeting/”satsang” is not a form of therapy, nor a substitute for therapy, nor treatment for illness, whether medical, emotional, psychological or physical and that Jon Bernie is not, and does not hold himself out to be, a licensed healthcare provider. I take full responsibility for all my actions and also waive, release and hold harmless Jon Bernie from and against any costs, fees, expenses, liabilities or claims, whether medical or legal, arising from any conduct or activity of the retreat, individual session or group meeting/”satsang” or its effects, including but not limited to injury, exacerbation of pre-existing mental, emotional or psychological conditions, death, theft or other liability, regardless of any act or omission by Jon Bernie.
As a material part of the consideration to attend or participate in this retreat, individual session or group meeting/”satsang,” I hereby assume all risks of injury to my person, whether physical, psychological or emotional, or damage to my property arising from any cause related to or arising from the retreat, individual session or group meeting/”satsang,” whether known or unknown, whether expected or unexpected. I further waive and release all claims I may have against Jon Bernie, and Jon Bernie makes no representations or warranties as to any benefit that may be received by attending a retreat, individual session or group meeting/”satsang.”
In connection herewith, I waive and release any rights I may have by reason of the provisions of California Civil Code Section 1542, which states as follows: A general release does not extend to claims that the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him or her, must have materially affected his or her settlement with the debtor.
